Terms of Service

These Terms of Service (the “Terms”) are a legal agreement between you and Wanderoon (referred to here as “we”, “us” or “our”) and govern your access to and use of the Wanderoon platform, websites, applications and related services (together, the “Service”). Please read them carefully. They work together with our Privacy Policy, which explains how we handle personal data.

1. Agreement to these Terms

By creating an account, or by accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation, and “you” refers to that organisation. If you do not agree to these Terms, do not use the Service.

2. Who we are and what Wanderoon does

Wanderoon provides software that lets travel organisers build, publish, sell and manage group trips, and lets travellers browse and book those trips. Wanderoon is a technology platform. We are not a travel agency, tour operator, or travel provider, and we do not organise, sell, or deliver the trips themselves. Trips are offered and run by independent organisers, and the contract for a trip is between the traveller and the organiser. We are not a party to that contract and are not responsible for the planning, quality, safety, or delivery of any trip.

3. Eligibility and your account

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the information you provide, for keeping your account credentials confidential, and for all activity that occurs under your account. Sign in is handled through our identity provider, and you may choose to use a supported social sign in. Tell us promptly at [email protected] if you suspect any unauthorised use of your account.

4. Organisers and travellers

  • Organisers are responsible for their trips, listings, pricing, descriptions, terms, cancellation policies, and for complying with all laws that apply to their business, including consumer protection, travel, tax and data protection laws. As between you and us, an organiser is the seller and the merchant of record for their trips, and acts as the data controller for their travellers’ personal data, with Wanderoon acting on the organiser’s behalf as described in our Privacy Policy.
  • Travellers book trips offered by organisers. Any question, change, cancellation or refund relating to a booking is governed by the organiser’s own terms and should be raised with that organiser in the first instance.

5. Bookings, cancellations and refunds

When a traveller books a trip, they enter into a contract directly with the organiser on the organiser’s terms. Cancellations, changes, deadlines, and refunds are governed by the terms and cancellation policy the organiser sets and displays at the time of booking. Wanderoon facilitates bookings, communications, and payments, but does not set trip prices or policies and does not decide the outcome of refund requests, which are a matter between the traveller and the organiser. 6. Payments, platform fees and credits

Payments are processed by third party payment providers. By using the Service to send or receive payments, you also agree to the applicable payment provider’s terms, and you authorise Wanderoon and the provider to process the relevant transactions, payouts, refunds, and reversals. Organisers are responsible for the accuracy of their prices and for any taxes due on their sales.

Wanderoon charges fees for use of the Service, which may include platform fees applied to transactions and charges for optional features such as AI credits. Applicable fees are those presented to you in the Service or in a separate written agreement. Except where required by law or expressly stated, fees and credit purchases are non refundable. We may recover amounts owed to us, including fees and reversed or disputed amounts, from your balance or future transactions.

7. Your content and licence

You retain ownership of the content you submit to the Service, such as trip descriptions, images, and messages (“Your Content”). You grant us a worldwide, non exclusive, royalty free licence to host, store, reproduce, adapt and display Your Content solely to operate, provide and improve the Service, including to display public trip pages and storefronts you choose to publish. You are responsible for Your Content and confirm that you have the rights needed to submit it and that it does not infringe the rights of others or break the law.

8. AI features

The Service includes AI assisted features that generate drafts and suggestions, for example draft messages, trip content, and dispute response drafts. AI output is provided to help you and is intended for human review before use. It may be inaccurate or incomplete, and it is not professional, legal, or financial advice. You are responsible for reviewing and deciding whether to use any AI output, and for ensuring that what you send or publish is accurate and lawful.

9. Acceptable use

You agree not to, and not to allow anyone else to:

  • use the Service to break the law, infringe rights, or facilitate fraud;
  • post content that is unlawful, misleading, harmful, or that you do not have the right to post;
  • attempt to gain unauthorised access to the Service, other accounts, or our systems;
  • interfere with, disrupt, overload, or probe the Service, or bypass its security or usage limits;
  • scrape or harvest data from the Service except as expressly permitted;
  • misuse the payment features, including to launder money or evade fees; or
  • resell, sublicense, or provide the Service to third parties except as intended by the product.

10. Our intellectual property

The Service, including its software, design, and the Wanderoon name and logo, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non exclusive, non transferable, revocable right to use the Service for its intended purpose. We reserve all rights not expressly granted. If you send us feedback or suggestions, we may use them without obligation to you.

11. Third party services

The Service works with third party services, such as payment providers, identity providers, email delivery, hosting, and AI providers. Your use of those services may be subject to their own terms, and we are not responsible for third party services. Links to third party sites are provided for convenience and are not an endorsement.

12. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the Service will be uninterrupted, error free, or secure, or that any AI output will be accurate. Because trips are provided by organisers, we make no warranty about any trip, organiser, or traveller.

13. Limitation of liability

To the fullest extent permitted by law, Wanderoon will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed the greater of the fees you paid us in the twelve months before the event giving rise to the claim, or one hundred euros. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

14. Indemnification

You agree to indemnify and hold harmless Wanderoon and its officers, employees, and agents from and against any claims, damages, liabilities, and reasonable expenses arising out of your use of the Service, Your Content, your trips or bookings, or your breach of these Terms or of any applicable law.

15. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or to protect the Service, other users, or our legitimate business interests. On termination, your right to use the Service ends, although provisions that by their nature should survive, such as those on payments owed, content licences, disclaimers, liability, and indemnity, will continue to apply. Where you act as a data controller, we will handle traveller data on termination as set out in our agreement with you and our Privacy Policy.

16. Changes to the Service and these Terms

We may update the Service and these Terms from time to time. When we make material changes to these Terms, we will update the date at the top of this page and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws applicable at Wanderoon’s principal place of business, without regard to conflict of law rules, and subject to any mandatory consumer protections that apply where you live.
